A hard legal battle promises to be in the United States. After the decision of the International Commercial Court that blocked the so -called “reciprocal” customs duties, the United States government is preparing to confiscate the Supreme Court, the greatest judicial authority in the United States, to be suspended. And this Friday indicates CNBC.
According to US media, the United States will request an “emergency measure” of the highest court if the Federal Court of Federal Appeal does not invalidate the decision issued in the first instance.
Following the decision to block customs duties, Donald Trump’s administration appealed and his collaborators attacked federal judges.
In Fox News, another advisor to the US president, Jason Miller, said that “we have not elected judges who try to impose their own will in terms of fiscal policy, commercial policy and all economic problems.”
“Noilitioned emergency”
As a reminder, the three judges, confiscated with two complaints (one of the 12 main US states, the other of the small US businesses), supervised the reciprocal customs duties (strong tax increases) decided by the White House without votes of the Congress on a basis of a state of economic emergency.
In their decision, the judges of the International Commercial Court considered that Donald Trump could not invoke this economic emergency law to establish these customs tasks. This text allows the White House tenant to “take the necessary economic sanctions in case of emergency to combat an extraordinary and unusual threat,” said the court.
An “emergency” not characterized in this case, according to the court.
The government expects the appeal to have published the decision to maintain high customs duties.
According to the United States government, the pressure is based on business partners is a key element of negotiation. The Secretary of the Treasury, Scott Besent, warned that this judicial decision “would destroy” the commercial agreement currently negotiated with China.
Even so, despite this judicial setback, Donald Trump is still far from losing the battle. There are still appeals, as well as other legal media (at least four according to Banca Goldman Sachs) to restore 10% reciprocal customs tariffs in imported goods to the United States.
