Charges of the succession bank limited to 850 euros maximum since November 13

A decree published this Thursday, August 14 in the official magazine, limits to 850 euros, the costs required by the banks for operations on account of a deceased from November 13.

No more “mourning taxes”? A decree published in the official magazine this Thursday, August 14, limits in any case to 850 euros the maximum amount of the costs that banks can charge for the operations carried out on account of a deceased. This measure, resulting from a law aimed at reducing and supervising bank charges on inheritance, voted and promulgated in May, will enter into force on November 13, 2025. And the amount of the roof can be revalued every year, on January 1, according to the evolution of inflation calculated by INSE.

Initially, the Law first had limited the bank charges billed by each operation carried out in the account or in the savings book of a deceased 1% of the total amount of the sums held. But this decree dated August 13 and published on Thursday still restricts the amount of costs billed by the banks. Therefore, the latter may not exceed 850 euros, even if 1% of retained sums represents a greater sum.

Prohibition of costs if the deceased is lower

As a reminder, the law at the origin of this decree had already provided the ban on banks to request, as of November 13, 2025, costs, for example, to close a brochure, if the deceased was minor. The same if the total balance of the accounts was lower than a certain threshold, for the moment established at 5,910 euros, or in the case of simpler successions.

Parliament had definitely adopted this law proposed by the socialist deputy Christine Pirès Beaune and supported by the Government. This initiative followed in particular the publicized case of the parents who have to pay 138 euros to close the brochure A of their 8 -year -old son who died in 2021. After the vote of the law, the minister delegated by trade and social and solidarity economy Véronique Louwagie had welcomed “an advance to protect families and guarantee confidence in the banking system.”
