Conventional ruptures are in the government viewfinder. Within its framework on the unemployment insurance agreement sent on August 8 to social partners, Prime Minister François Bayrou invites unions to “negotiate multiplication so often observed in recent times individual conventional ruptures and embezzlement of their object, with a strong impact on unemployment insurance.”
In force since 2008 in the private sector, conventional ruptures have in fact increased in recent years. Dares, the statistical service of the Ministry of Labor, tells 514,627 in 2024. And above all, the trend accelerates, with an increase of 20% since 2020.
As a reminder, conventional termination makes it possible to end the employment contract friendly in the employment contract. If the government points to employees that it is more likely to request it, it can also be the initiative of the employer who, often advised by lawyers or lawyers, can favor this method to avoid any risk of sometimes long and expensive litigation in case of dismissal.
Commerce and services in mind
However: all activity sectors are not used as much as others for conventional breakup. In 2024, according to commercial and commercial services, commercial services were, with much, the most fond of 98,266 and 97,833 conventional ruptures signed respectively.
Quite back, accommodation and catering represent the third sector where there are more conventional ruptures: 57,909 were signed in 2024. Then the construction follows (56,314), teaching, human health and social action (41,247) or information and communication (31,720). Conventional ruptures seem more rare in industry, transport, but also in real estate, insurance and finance.
It should be said that according to collective agreements, contractual termination assignments are more or less generous. Some receive a month of gross salary multiplied by the number of years of age where others receive only half, or even a quarter of the monthly gross remuneration, multiplied by the number of years of seniority.
In order for the contractual termination system to be less attractive, the Ministry of Labor is thinking of lengthening the period of deficiency prior to the opening of unemployment insurance for the beneficiaries of a contractual termination.
