Visa rates of $ 100,000: a coalition attacks Donald Trump’s decree, considered “unconstitutional and illegal”

A coalition of hospitals, schools and unions attacks the presidential decree that provides costs of $ 100,000 in the H-1B visa, which allows foreigners to be recruited.

Donald Trump’s decree that imposed $ 100,000 to a precious visa in the rich technology sector was attacked on Friday, October 3 by a coalition of hospitals, schools and unions that denounce the impossibility of recruiting foreign doctors and teachers at this price.

The allocation, deposited with the Federal Court of San Francisco, denounces this decree as “unconstitutional and illegal,” the plaintiffs wrote in a press release.

Among them are the Nursing Network of the “Global Nurse Force”, the UAW International Automobile and Aeroospace Syndicate, the American Association of University Teachers (AAUP) and several Protestant religious organizations, among others.

They attack the decree signed on September 19 by the US president that imposes $ 100,000 rates at the request of companies that recruit through the H-1B Visa, accused of being used by the rich technological giants to recruit talent abroad instead of in the United States.

85,000 visas per year

According to the complaint, the conditions of this visa should have been reviewed by the Congress and not by a presidential decree that “attacks the national community” by endangering recruitment within hospitals and rural schools, as well as certain NGOs or the discouraged charitable research centers.

The H -1B visa has been created to allow employers to sponsor very specialized foreign workers (scientists, doctors, engineers, teachers, shepherds, and whose qualifications are not very widespread in the United States. Initially for a three -year period, which can be extended up to six years.

The decree also refers to French schools in the United States, which also uses it to recruit French -speaking teachers.

The United States offers 85,000 H-1B visas per year according to a lottery and India system represents three quarters of the beneficiaries. SUCTAR PICHAI, the head of Google, or Satya Nadella, that of Microsoft, as well as Elon Musk, arrived in the United States thanks to the H-1B visa.

Around “60% of the main new companies in artificial intelligence in the United States were founded by immigrants”, “that would not have been possible without the H1-B program,” said Jeremy Neufeld, an expert in migration policies at the Research Center of the Institute for Progress, interviewed in the “Hard Fork” podcast.
