Seniors Index: Olivier Dussopt evokes a sanction for recalcitrant companies

The government plans to implement an index on the employment of older adults in companies with more than 50 employees, accompanied by a possible sanction for those who refuse to publish it, the Minister of Labor said Thursday. During a progress report on the pension reform, Olivier Dussopt considered that the increase in the employment rate of the elderly, low in France (33% between 60-64 years), was a “condition for success” From this project.

Among the levers for action, the minister wants to “replace the employment of the elderly at the center of social dialogue.” The Government wants to “create a seniority index that will be negotiated in each branch”, which takes into account the age pyramid of the corresponding professional sector, and published by companies with more than 50 employees, she specified. “This will promote good practices but also penalize bad ones, and we are considering a possible sanction for those who do not comply with this publicity obligation,” the minister continued.

Entrepreneurs oppose the senior index

The employers, through the voice of the president of Medef, Geoffroy Roux de Bézieux, have already expressed their opposition to the establishment of such a system, inspired by the current one to measure professional equality between women and men. A possible sanction would point to the denial of the realization and publication of the index. As for the poor results, they could be the subject of a social bargaining obligation with a view to a collective agreement on the employment of older people, Olivier Dussopt said.

The minister mentioned other “very specific responses”, including a combination of employment and retirement creating rights that allow a revaluation of pensions, as well as access to gradual retirement facilitated and open to civil servants.

The executive also intends to “avoid” that a resumption of activity could mean, for senior job seekers, a loss of remuneration. To this end, the government is considering a “bonus” that it wishes to discuss with the social partners under the unemployment insurance scheme that will come into force on January 1, 2024, Olivier Dussopt said.
