TAP has already sent the government a justification for the amount of half a million euros in damages that Alexandra Reis paid to leave TAP. Initially, the current State Secretary of Finance even asked for compensation of 1.4 million euros.
“The government understands that it will immediately forward the clarifications of TAP’s Board of Directors to the General Inspectorate of Finance and the Securities Market Commission for review of all facts relevant within the scope of their scope of action,” the statement read. . joint statement of the Ministries of Finance and Infrastructure released this Tuesday.
The airline begins by recalling that Alexandra Reis joined TAP on September 1, 2017 on a permanent employment contract, which was suspended when she was appointed to the Board of Directors for the period between September 30 and December 31, 2020. by the private shareholder, however removed, David Pedrosa. However, this promotion did not detract from Alexandra Reis’s previous years at TAP, allowing her to continue to overcome the former manager’s seniority, the company justifies.
On January 1, 2021, the administrator was reappointed by the previous administration of António Costa for a four-year term ending December 31, 2024.
TAP clarifies that both the employment relationship and the contractual termination fall outside the regime of the Statute of the Public Manager, so that the restrictions do not apply in terms of salary, which must be lower than that of the Prime Minister (5792 euros), nor compensation through dismissal for the convenience (12 months salary).
Upon completion of the legal framework, the company reveals that it was at the initiative of TAP that “the negotiation process was initiated with Alexandra Reis to reach a consensus on the immediate transfer of all existing contractual ties”. That is, the former manager actually submitted her resignation, as indicated in the airline’s statement sent to the CMVM in February, but this was done in response to an invitation from TAP to Alexandra Reis to leave.
It was agreed on February 4 that the termination with all TAP group companies will take effect on the 28th of the same month.
“In exchange for the termination of all contractual relationships, and despite Alexandra Reis’ initial claim of EUR 1,479,250, it was possible to reduce and agree on a global total gross amount of EUR 500,000 to be paid to Alexandra Reis. paid”, is in the note sent by the airline to the government, which the Ministries of Finance and Infrastructure released on Tuesday.
Of the half million to be paid to Alexandra Reis, 56,000 euros “specifically correspond to the compensation for the termination of the employment contract for an indefinite period of time” and 443,500 euros relate to the “compensation for the early termination of mandates related to management positions “, he explains. the tap. In the statement to the government, the company also indicates that of the 443,500 euros, 107,500 euros relate to overdue compensation corresponding to unused vacations, and 336 thousand euros to compensation not yet due and corresponding to a base salary, taking into account the gross salary without discounts due to emergency agreements or other deductions.
TAP also draws attention to the fact that this partial compensation amount of 336 thousand euros, which relates to a salary year in which Alexandra Reis did not have to work because she agreed to resign as a director, is “lower than the annual base”. salary” of the former manager (350 thousand euros).
