It must be said that, since the end of last week, one after another, the big names in distribution have come forward against his bill. Michel-Edouard Leclerc took out the first one, on Thursday, on his blog and social networks, denouncing “a scandal” for the benefit of multinationals and at the expense of consumers.

He was followed by the head of System U, that of Intermarché, but also the president of the Federation of Commerce and Distribution (FCD), Jacques Creyssel. As the law allows, Frédéric Descrozaille modified certain measures of his text until the last moment, this Tuesday. And it is this new version that will be examined this Wednesday by the deputies of the Finance Commission of the National Assembly.

Precautions and “nuances”

In the previous version, in particular, it was questioned that in the event of a disagreement between distributors and suppliers at the end of the period of commercial negotiations, on March 1, it is the supplier’s tariff that applies. Finally, the speaker explains, if there is no agreement on March 1, there will be a transitional period of one month, during which the business mediator may be seized, and it is until the end of this period that there will be a “pause.” in the business relationship or resumption of talks”.

Egalim’s measures on the loss resale threshold or the promotion framework, “in the experimental phase”, and the extension of the promotion framework to non-food products, which Frédéric Descrozaille had removed from his text, are extended by 3 years , will be discussed through an amendment.

Deputy Renacimiento also specified that he had ensured the legal strength of article 1 of his text, which establishes that it is the French commercial rules that apply in negotiations between suppliers and distributors, to products that are marketed in France, even if the negotiations take place. at the level of the European purchasing centers.

So many precautions and “nuances” taken around an invoice, which affects manufacturers, distributors, producers, but also, of course, in the end, the consumer and his purchasing power.
