This is the first visible consequence of the unemployment insurance reform: the duration of compensation for the unemployed will be reduced by 25% on February 1, 2023. The decree published this Friday in the Official Gazette came to specify the measures announced by the government last fall. Because now, and until the end of the year, the executive sets the compensation rules by decree, as provided for in the “labor market” law recently approved by parliamentarians.
As confirmed by the decree, the duration of the compensation for the unemployed is now modulated depending on the economic situation. If the unemployment rate falls below 9% or if it falls for three consecutive quarters, as it is today, France enters a “green period”. In this case, the duration of the rights is then reduced by 25% for the beneficiaries. More specifically: if before the reform we were entitled to 24 months of compensation, now we go to 18 months.

This measure will only apply to the newly unemployed: the reduction in the duration of rights refers to people registered in Pôle emploi whose employment contract ends as of February 1, 2023. Furthermore, if the dismissal procedure is initiated Before February 1, 2023, the measure will not be applied, the decree specifies. Note: having set a minimum floor of six months for the duration of the compensation, the first effects of the reform will not be felt until August 1, 2023.
The decree also confirms that intermittent entertainers, fishermen and stevedores are excluded from the reform. These new rules will not apply in overseas France either (Guadeloupe, Guyana, Martinique, Réunion, Saint Barthélemy, Saint Martin, Saint Pierre and Miquelon). The decree itself will end on December 31, 2023: by then, the social partners will need to negotiate new rules applicable on January 1, 2024.
