“It’s very shocking to say the least.” Although part of the stock of furniture and decoration of Made.com will be resold at bargain prices by discount specialist Nozwounded French clients blame the coup, like this member of the facebook group “Made.com/In France/customers awaiting delivery or refund” (to date 1800 members), joined BFM Business.
“I can’t quite understand how products that belong to customers (because they were paid in cash) and have never been delivered, are stolen from them without return (that I know of) to be resold by someone else,” explains another. customer, whose order of 1900 euros has never been delivered or refunded.
The British online furniture seller went bankrupt when around 12,000 customers had orders in progress, including more than 1,000 in France. Orders that have not been delivered or refunded.
However, a large stock of furniture and objects has been placed auction last December by the liquidating administrator in order to reimburse creditors. Particular auctions won by the French Noz which announces this Friday that it has bought the equivalent of 450 trucks of merchandise, or 141,000 pieces. These products will be resold at a 70% discount starting February 7.
For some French customers, there is no photo, in these goods resold by Noz, perhaps, surely, there is the piece of furniture or the object ordered but never delivered.
The administrator of the Facebook group that brings together aggrieved clients captured a volunteer lawyer specializing in class actions a few months ago. The latter speaks of a “legally very difficult fight”, in particular because British law applies.
Still, Noz’s purchase of the shares will lead to legal action. “How is it possible to pay 100% of an order, see the company go out of business and see the goods resold a second time?” asks Master Emma Leoty.
“I’m filing a complaint this weekend to try to discourage Noz from reselling these items. Because they may belong to aggrieved customers. But the chances of success are very slim because it will be almost impossible to prove that such furniture actually belongs to such a person, Noz for therefore you can say that you are within your rights. And very few remedies are possible,” he explains to BFM Business.
The situation is even more difficult for these affected French customers because “very few” have been reimbursed, not by Made or PWC (the administrator), but by their banks. a real lottery which depends on the good will of the banking establishments and the motivation of the clients.
