While the social climate within FDL had hardened this winter due to initial rumors of asset transfers, this decision was prompted by the non-payment of July salaries and the company’s announcement on August 9 that it would cease all activity. .
In the process, a few dozen employees protested on August 17 outside the Amazon warehouse in Noisy-le-Grand.
According to Amazon, quoted in a local press article indexed to the judgment of the Commercial Court of Bobigny, the group “terminated” its contract with FDL, without further details, after recalling that the delivery companies it uses “must follow the Code of Amazon Suppliers”. of conduct”.
Application for criminal proceedings
In its press release, however, the CSE protests the practices of the company and its manager, who was not present at the hearing.
The CSE “is aware of the withdrawal of the trucks by the company as of August 13, and their repatriation to the Belgian subsidiary, which constitutes an improper appropriation of the few assets of the French subsidiary.”
Consequently, it announces that it is requesting “the public authorities to initiate the necessary criminal proceedings to sanction these crimes defined by the FDL company.”
According to the CSE’s lawyer, present at the hearing on September 5, which was not disclosed, the president of the court described the manager’s behavior as “overwhelming”, while the prosecution indicated that it “considered opening judicial proceedings.” proceeding for embezzlement”.
