Almost 70% of dismissals for serious misconduct are due to job abandonment, according to Dares

In the first half of 2022, around 70% of dismissals for gross or gross negligence in the private sector were motivated by job abandonment, according to a Dares study published on Wednesday.

Seven out of ten dismissals for serious misconduct are justified by abandonment of work. This is demonstrated by a study by the Directorate for the Animation of Investigations, Studies and Statistics (DARES), published this Wednesday, regarding a sample of companies that have carried out this type of layoffs in the first half of 2022.

“In the first half of 2022, 173,000 employment contracts in the private sector were terminated due to dismissal due to serious or serious negligence,” the Dares document indicates. “71% are justified by abandoning work,” he adds. This is the “first reason before those of a disciplinary nature”, which account for 27% of dismissals for serious misconduct.

In the vast majority of cases (94%), it is permanent job abandonment and in rarer cases (6%). In all, 123,000 job departures resulted in dismissal for gross or gross negligence in the first half of 2022, of which 116,000 were permanent contracts, according to Dares.

No more abandonment in trade, transport and storage

In detail, it is in commerce, transport and storage where employees leave their permanent contracts most frequently. Job abandonment represents 18% of involuntary CDI terminations and 7% of CDI terminations. On the contrary, they are rarer in industry and construction (4% of CDI terminations in these sectors).

Among the employees who resign their CDI, 37% access a new job at least once in the following three months. Almost a third (30%) of them find an indefinite contract, an identical proportion to that observed for employees who terminate their indefinite contract by mutual agreement.

The latter are also potentially eligible for unemployment insurance. On the other hand, resigners, who are not, are much more numerous in proportion to finding a CDI (69%). Finally, 43% of people who leave their CDI open the right to unemployment insurance within three months, reveals Dares.
