The 31 texts that implement the pension reform will be published before September 1, the date of entry into force of the reform, reported this Wednesday the office of the Minister of Labor, Olivier Dussopt. “There is no delay, we will be there,” Olivier Dussopt’s cabinet said in a telephone briefing.
“There is a priority way” to first publish the texts “that condition the age of departure”, and those “that give new rights” such as the increase to 85% of the Smic (1,200 gross euros) of the minimum pension for all those who have contributed a full career (43 years), said the same source. The unions are vigilant and will not stop rushing into the slightest legal breach when the decrees are published. For the moment, two draft decrees have already been drafted by the ministry’s departments, and are currently subject to consultation, in particular with the National Old-Age Insurance Fund, according to Olivier Dussopt’s cabinet.
One of these two decrees, relating to the application of the reform to public officials, was submitted to the opinion of the Council of State. Other decrees, the number of which is still unknown, will follow this path to obtain maximum legal security. On the sensitive issue of the revaluation of the minimum pension, this will become effective as of September 1 for all people who retire after that date, Olivier Dussopt’s cabinet said.
For all the people who are already retired, but who should benefit from it (1.8 million people), “the majority” will receive an increased pension as soon as they pay their pension for the month of September, at the beginning of October, according to the Ministry. For the rest, their pensions will be revalued “in the following months with retroactivity” to September 1. In general, “no person” currently retired will have to go back to work when the detailed rules of the game for the reform have been established, the office of the Ministry of Labor assured.
