Gas: Italian group Eni convicted of aggressive prospecting

The Paris court ordered Eni to pay 100,000 euros in damages for its abusive prospecting practices.

The operator Eni was sentenced on Tuesday for “aggressive commercial practices” and “sales without a prior order” of gas contracts, by the Paris court where he was summoned by the CLCV consumer association, the latter learned on Friday.

The Court of Justice of Paris, instructed by facts dating mostly from 2019 to 2020, considered “that the Eni-Gas company surrendered, due to the marketing of its products through company requests, aggressive commercial practices and sales without notice. order”, and ordered the cessation of their practices.

Obligation to publish the sentence on your site for 3 months

Consequently, the court orders Eni to pay the CLCV the sum of 100,000 euros in damages “in compensation for the damages caused to the collective interest of consumers”, according to the ruling.

Eni is also ordered to publish this sentence for three months on the home page of its website and its applications, within a month, “under a provisional penalty of 3,000 euros per day of delay at the end of this period.”

Voters under a false identity

Alerted about the methods of attracting certain energy providers, “in search of new customers in a very competitive market”, the CLCV had assigned Eni in 2020. The association provided fifteen consumer testimonials.

These testimonials denounce “false claims, such as the impossibility of keeping your current provider, to encourage the consumer to sign” or “the use by certain direct sellers of a false identity,” says the CLCV.

“Do not respond to any survey”

The CLCV welcomed “a strong signal in the face of the abuses that are regularly observed in the context of attracting customers in general”, noting that the facts denounced “refer to a time when energy companies were very aggressive in attracting Of customers”.

He fears a resurgence of this type of behavior, while the regulated gas tariff will disappear on June 30, and advises consumers “not to respond to any polls.”
