EHPAD MALTRATE: 55 establishments led by “serious sanctions” for three years

Three years after the abuse scandal in EHPAD, a vast control plan made possible seriously about fifty establishments that fail.

Run in 2022 in response to the ORPEA scandal to “recreate trust”, the vast control plan for French elderly homes allowed to identify 55 particularly problematic structures, which received “serious sanctions”, according to the Minister of Autonomy Charlotte Parmentier-Ecocq.

“The immediate closure of the establishment or the tutoring of serious acts of abuse, important dysfunctions, care care problems” of the elderly, specifies the Minister of Autonomy, within the framework of a debate “in the heart of the EHPAD, of the indifference to the action” scheduled Tuesday night in France 2.

The 7,500 hpad of controlled France

This engraved debate will be transmitted after the documentary “Les Fossoyeurs: in the heart of the Ehpad scandal”, adapted from the investigation of the book of the Victor Castanet journalist. In January 2022, the publication of this book, “Les Fossoyeurs”, had caused a large -scale scandal by revealing cases of embezzlement of financial funds and abuse of the elderly in certain establishments of the Orpea group (renamed Emeis).

Given the emotion, the government of the time had announced that the 7,500 EHPADS in France would be verified in two years and forced more transparency with respect to their services and their use of public funds.

At the end of December 2024, 96% of these establishments had been reviewed, reports Charlotte Parmentier-Ecocq in the program, seen by AFP. Responsible for the controls, the Regional Health Agencies (AR) “were for a third in the sites”, “prioritize those for which there were elements of doubt or alert.”

“Put transparency”

In parallel, they verified “on paper, on the basis of elements that EHPAD must provide in terms of figures, in terms of turnover (Personal, editor’s note), the presence of employees, disease stops, attention problems, serious events and that have sometimes been able to lead to control, “he adds.

“We must put transparency in the system, we must find confidence,” insists the minister. “If we do not have this transparency, we do not meet the expectations of families and family members. And when you pass there are all the establishments and professionals who do their job well, which conform and degrade when these are precious professions we need,” he adds.

From the scandal, measures have been announced to strengthen controls, some of which appear in the “Aging Law”.

Adopted in 2024, this text particularly provides the implementation of quality indicators with respect to the way in which residents are compatible. EHPAD is also required to follow nutritional rules, in nutritional quality, such as quantity.

Daily visit rights

EHPAD residents are also recognized from a daily right of visit, without having to inform the establishment in advance.

In terms of financial management, the law also establishes a declaration of the control of managers of establishments to the supervision authority, which can oppose it in two months.

At the same time, a 2024-2027 national strategy has been launched that fights against abuse, with the aim of leaving “omerta” against abuse sometimes suffered by the elderly, disabled or precarious in social and medical medical establishments.

Insisting the role played by the national number of fight against the abuse of elders and disabled (3977), Charlotte Parmentier Lecocq considered important “that families can be improved.”

Measures, however, insufficient in the eyes of the Association of Directors at the service of the elderly (AD-PA).

Three years after the ORPEA scandal, “the State does not offer any solution at this stage to increase the number of professionals and finally provide services that meet the expectations of the elderly and their families,” said the association in a statement published on Monday.
