Operated by cancer that did not exist. A 45 -year -old patient, who prefers to remain in anonymity, was hospitalized for rectum cancer at the Louis Pasteur hospital in Dole, in Jura. The intervention was really useless and then led to complications. Now request compensation, the progress of the report and the Republican yes.
In 2012, the Dolois suddenly became strong pains “on the side.” Suffering so strong that he decides to go to the closest emergencies, located at the Louis Pasteur hospital.
A little more than a week later, the patient undergoes a colonoscopy during which, according to his doctors, a “cancer polyp” is eliminated.
Five operations
As he thinks he left the business, the forties learn a difficult news from their doctor: he has cancer. “If you don’t work, you’ll die,” warns the surgeon.
Therefore, in June 2012, the Dolois went to the operations table to undergo a “rectal resection”, that is, part of its rectum is removed. Unfortunately, the intervention does not go as planned, because doctors “pierced the intestine,” he says. Therefore, you must undergo a new operation the next day.
But, again, practitioners again pierce their intestine involuntarily. Due to these repeated medical errors, the forties will be operated five times.
“Disabled for life”
These repeated medical interventions are not trivial and have consequences on patient’s health. During his hospitalization, he will have to go through the resuscitation service for a while, while his vital prognosis will be considered twice as committed.
Since then, Dolois has maintained the consequences of these medical errors. In the space of a few months, the young father, healthy, has become dependent.
“I am disabled for life with total anal incontinence,” deplora.
For him, it is now impossible to have a professional life and even leave his home without being accompanied.
A medical report agrees with the patient
The forties decided not to let it go. He began the prosecution against the Dole Hospital that he claimed 1.9 million euros.
After years of legal battle, a medical report established in 2020 that the first operation “was not justified when cancer had completely withdrawn from biopsy (colonoscopy, editor’s note)”, reports Le Progès.
In addition, the experience indicates that Dolois should also have been “informed” of the complications suffered and transferred to a “specialized service” for better attention. For its part, the hospital does not comment, invoking “medical confidentiality.”
A rejected compensation offer
In 2021, the Committee for Conciliation and Compensation of Medical Accidents also agreed to the patient, believing that the responsibility of “all damages” returns to the Dole Hospital, and requires that the forties be compensated through the hospital insurer.
The patient says that he later received a compensation offer of 216,870 euros, a proposal that rejects because he is not up to the damage suffered, according to him.
Now, the forties feel like being at a dead point. “May the hospital unlock the situation,” he calls. Unemployed, he refuses to receive a disability pension “not to penalize the taxpayer” and, therefore, has no income. More than ten years after its operations, justice still hopes.
