“A dedicated caregiver”: a British escapes prison for killing his father in the cancer terminal phase

Confessions shortly after the facts

The doctor who pointed out the death of Barrie Davenport concluded for the first time that it was a death of natural causes, because his death was expected imminently due to his terminal illness.

“The evidence suggests that after his diagnosis of terminal cancer, the defendant was a caregiver dedicated to his father, while his health was decreasing,” said John Price during the trial, to contextualize the gesture of Lisa Davenport.

“It is fair to say that no one could have done more than by a father who dies manifestly,” added the prosecutor.

The latter also added that in the hours and days that preceded his death, Barrie Davenport had great suffering, that drugs did not allow to keep under control.

Lisa Davenport “was upset by her father’s appearance. She asked her to receive more analgesics. This context could explain why a devoted girl became so much towards her father that night,” John Price concluded during his supplication.

Lisa Davenport supported by her family

Defensor lawyer Mary Prior insisted, during her allegation, about the love her family had in Barrie Davenport. “Everyone loved their father and grandfather,” said the lawyer, adding that “despite the fact that (Lisa Davenport) caused the death of his father, (the members of the Davenport family) love her all, support her and are present in court to support her.

“He acted in a few seconds to avoid suffering for minutes, hours or even days,” said the lawyer.

Finally, Mary Prior supported the fact that a prison sentence against Lisa Davenport would not only punish her, but also to the other members of her family, including her two children.

Exceptional clemency

After the various allegations, Judge Linden finally sentenced Lisa Davenport to two years in suspended prison, an obligation to take care of 12 months to treat her mental health and her alcohol dependence and a curfew from 8 pm at night at eight in the morning.

“There is no evidence of premeditation and I also accept that his only motivation was to put an end to his father’s suffering and that he acted because his death was close,” said the judge.

To explain his particularly mild sentence, Judge Linden invoked “mitigating circumstances […]Exceptional, “while recalling that” no one is allowed to take the matter in their own hands alone. “

The British Parliament is examining a bill on medical assistance to die for sick adults in the terminal phase. This law could allow sick people with a life forecast for six months or less get help to finish their day.
