End of life: parliamentarians approve the procedure to request help to die

According to the bill, a person who asks to access help will have to do it with a doctor “who is not his father, his ally, his spouse, or his partner, or the couple to whom he is bound by a Civil Solidarity Pact, or his right.”

The deputies also wanted to specify, adopting an amendment to the government, that the request made by the patient to the doctor would be expressed “in writing or by any other mode of expression adapted to their abilities.”

Impossible to send several requests simultaneously

The initial version only mentioned “express request”, referring details to a decree in the State Council. The text establishes that the same person cannot simultaneously send several applications, and that a request cannot be submitted “during a teleconsultation.”

An amendment of the deputies of the Independent Liot group has also been adopted to specify that the application can be collected in the “address” or “anywhere where the person is attended, if the latter cannot go to their doctor.

The doctor will have to inform the person about his state of health and that he can benefit from palliative care. The text also establishes that the doctor “offers the person and their relatives to guide them towards a psychologist or a psychiatrist.”

Collegiality problems

The deputies on the right have tried to consult a psychologist or a systematic psychiatrist.

“Because you can have depressive disorders, particularly anxious, which can (…) alter the trial,” said Deputy Philippe Juvin (Les Républicins). “It is putting the patient under guardianship and putting it in the hand of a psychiatrist’s decision,” replied environmentalist Sandrine Rousseau.

The Minister of Health, Catherine Vautrin, emphasized that the government will carry, in the rest of the text, an amendment that stipulates that the doctor collects the opinion of a psychiatrist “when he has serious doubts about the discernment of the person.”

The parliamentarians must now discuss the continuation of the procedure, in particular issues of collegiality to decide whether or not to access a request for help to die.

On Tuesday, the deputies approved five accumulated conditions required for a patient to be eligible for the right to help die. Voting above all the text, at the beginning, is scheduled for Tuesday, May 27. Some 1,100 amendments are still being discussed.
