The LGBT+ Association Association welcomes the elimination announced by the establishment of French blood (EFS), data that mention homosexual relations, a contraindication for a long time for blood donation, which had maintained despite the condemnation of European justice.

France condemned by the CECH
In 2016, the law authorized homosexuals to give their blood, which has been prohibited since 1983 on the reason for the risks of AIDS transmission, provided they have been abstinent for a year.
This period was reduced to four months in 2019, before this condition was lifted in March 2022, any reference to the sexual orientation that disappears from the questionnaires before the donation.
But in September 2022, the European Court of Human Rights (CEDH) condemned France for violation of the right to privacy, the EFS that had retained data on a supposedly homosexual car did not want to indicate its sexual orientation, whose blood donation had been rejected several times.
“Sensitive”, the data related to the candidates for blood donation must be “exact, updated, adequate, relevant and not excessive compared to the persecuted purposes”, and should not be maintained more than the “necessary” time, then the court had affirmed.
The association is still “vigilant”
On Friday, the director general delegate of the EFS Sara-Lou Gerber clarified that the establishment will be eliminated “in mid-September, the largest data” called RSH (for “sexual relations with men”) and the rest at the end of 2025, of its archives, confirming liberation information.
In 2022, EFS, who did not specify the number of files that are treated, had preferred “not immediately eliminating” these data, having “questions about what to do,” he said.
All say that they are still “vigilantes”, the EFS “did not respond” to their “request for details during the data collection period chosen to proceed with this erase” and not communicate in the future of the “data on lesbian women recorded before 2002”.
Ask for an official communication of the EFS on this destruction of data and an “audit about its respect for the GDPR regulations,” Romain François, its president, said.
