“I hate”: the University Hospital of Nantes condemned after the removal of a patient’s penis

The care of the patient, aged 30 in 2014 during the first surgery after a diagnosis of carcinoma (a type of cancer, editor’s note), “was characterized by culpable breaches such as engaging the responsibility of the CHU”, writes the administrative court. from Nantes.

“It’s unthinkable!”

The CHU’s error caused the patient to lose “70% chances of avoiding recurrence (of carcinoma) by having led to the total removal of the penis” of the patient during new operations in the following years until June 2017, according to the decision consulted by AFP. .

“I hate this doctor who did not listen to me,” denounces the patient, questioned by France Bleu Loire Océan. “He played Russian roulette with me!”

The amount of 61,376 euros that the CHU must pay the patient covers the different damages taken into account by the court, including “the suffering endured” (12,000 euros), the “permanent functional deficit” (16,000 euros) as well as the “damage sexual” (31,500 euros).

A “social death”

The victim, who asked the CHU for a total sum of 976,000 euros as compensation for the damage suffered, has already announced his intention to appeal. “I will not allow myself to be humiliated,” she commented in a reaction sent by her lawyer, Me Georges Parastatis.

Referring to the “social death” of his client, the lawyer told AFP: “This man suffered a first psychological death due to medical negligence and a second today due to this demeaning trial of human dignity.”

“Of course, we are going to appeal in the hope that the appellate court will see this case in a more humane and not intellectually rigid way,” the lawyer continued.

It regrets that, in the sentence handed down this Wednesday, the “physical and mental suffering” was taken into account for the requested compensation “only within a strict framework of pre-established nomenclatures for enarques”.
