At the dead point, the second term of Emmanuel Macron sees the threat of a motion of dismissal floating. For this motion, rebel elected officials are based on article 68 of the Constitution. “The President of the Republic can only be fired in case of a violation of his duties obviously incompatible with the exercise of his mandate,” is written there.
To date, and since its conception, no dismissal procedure has led, despite several attempts, against François Hollande in 2016, by the elected officials LR, and in 2024, already by the rebel of France against Emmanuel Macron. This difficulty is linked to the complex route crossed by the movement before achieving its purposes.
A complex course, which has never been successful
At first, this proposal for a resolution must collect the signing of at least one tenth of the members of the National Assembly or the Senate, depending on the Chamber in which the procedure was activated.
The Office of the National Assembly or the Senate (depending on where the application arrives) can automatically rule out the resolution proposals that would not meet the conditions. The stage of a transmission to the Law Committee comes: this can refrain from examining the text. The Law Commission may not decide to examine and adopt it or reject it. In both cases, the proposal must be registered on the public meeting agenda within 13 days.
Then comes the exam in the public session, in the National Assembly or in the Senate. To be adopted, the majority of two thirds is necessary. If this threshold is reached, the proposal is transmitted to the other assembly that must be decided within two weeks. If rejected, the procedure is completed.
Otherwise, the Superior Court, composed of the members of the National Assembly and the Senate, must decide within a month.
Subsequently, the approval of the National Assembly office takes the motion to the Law Committee, where it must be adopted, before a vote in Hemicyle in the public session. Like the Senate, at least two thirds of elected officials must vote to go to the last stratum, the Superior Court, composed of 22 members equally between senators and deputies, who must meet. Again, the majority of two thirds is necessary to pronounce the president’s dismissal.
If the dismissal is voted, it ends with the functions of the President of the Republic. It is temporarily replaced by the president of the Senate, currently Gérard Larcher. Then a new presidential election is organized.
