OE2023: Landlords can request a maximum of two advances

The rent advance cannot exceed two months, according to a proposal by the Left Bloc approved in parliament this Thursday, which aims to counter “the abuse of guarantees” currently demanded of tenants.

The first version of the proposed amendment to the state budget for 2023 (OE2023) presented by the BE limited that advance to one month, but the bloc eventually accepted the suggestion of the PS to increase it to two months.

The approved text thus provides that the payment of the rent may be advanced, by written agreement, for a maximum period of two months, whereby the parties can guarantee, “by one of the forms provided for by law, the fulfillment of the respective obligations, up to the amount corresponding to two rents”🇧🇷

BE justifies this proposal with the need to end the abuse of the guarantees requested from tenants to continue the lease, referring to the fact that reports are common demanding one year’s rent in advance, a situation which , warns the party “it’s illegal”.

“The amount requested in advance for rent and security deposit makes it impossible for many people to access the lease and is a disproportionate requirement that needs to be corrected urgently, limiting the amounts that can be asked for the performance of a lease contract”🇧🇷
