Speaking at a press conference at the party’s headquarters in Lisbon, Chega’s president stated that “Article 167 of the Constitution prohibits the holding of referenda that have been definitively rejected in the same legislature, which means that the PSD project is unconstitutional because it cannot be in a year in which a different referendum proposal has been tabled”.
André Ventura recalled that on June 9, parliament “failed” Chega’s draft resolution calling for a referendum on the decriminalization of medically assisted death.
Article 167 of the Constitution states in point four that “projects and proposals for laws and referenda which are definitively rejected cannot be renewed in the same legislature, with the exception of a new election of the Assembly of the Republic”.
Chega’s leader suggested that “there should be an agreement between the four main parliamentary political forces – PS, PSD, Chega and Iniciativa Liberal – with the President of the Republic so that a referendum can be launched in the next legislature, because never could be sooner, from October 2023”.
