Domestic violence: first green light from deputies to text that creates mandatory disqualification

This bill seeks to extend the disqualification penalty to a series of convictions for aggravated violence, for example against the spouse.

Despite the reservations even in the majority, the deputies validated a bill on Tuesday in commission that creates a mandatory disqualification sentence for the perpetrators of domestic or intra-family violence in particular, which follows the Adrien Quatennens case.

This text presented by Aurore Bergé, patron saint of the majority Renaissance group, will be examined in the Assembly Hall next Tuesday.

Together with the president of the Law Commission Sacha Houlié, the deputy had presented it on January 11, the same day Adrien Quatennens returned to the National Assembly.

“Our objective is to guarantee the exemplarity of the elected officials”

The member of the North was sentenced in December to four months in prison suspended for “violence” against his wife. He was suspended for four months from the group of deputies of the LFI, until April 13, and in the meantime he sits as an unregistered deputy.

The bill seeks to extend the mandatory additional penalty of disqualification, for five or ten years, to a series of aggravated acts of violence: those committed against a child under 15 years of age, a vulnerable person, the spouse, with a weapon, or even in the racist motivation event, having given rise to total disability for work of less than or equal to 8 days, or not having given rise to ITT.

“Our objective is to guarantee the exemplarity of the elected officials”, Aurore Berge said before the Legal Commission. But it has provoked the ire of many of his colleagues who see it as the translation of the principle “one news, one law.”

“A crude and dangerous instrumentalization”

“We are very secretive with this text,” allied groups Horizons and MoDem said together. “It’s a communication blow,” said Ian Boucard (LR), who rather judges that Adrien Quatennens “must be defeated at the polls.” “We must never give in to the dictatorship of emotion,” added Pascale Bordes (RN).

Left-wing deputies also expressed their reluctance, and Danièle Obono (LFI) was the most virulent when pointing out “a crude and dangerous instrumentalization of justice and the fight against violence against women for vile political purposes.”

While each field sent cases of investigated deputies or ministers, Aurore Bergé launched: “we must all sweep in front of (our) door.” He recalled that the bill, if approved by Parliament, will not be retroactive and will not apply to Adrien Quatennens.
