Montenegro says that reviewing the euthanasia certificate afterwards is worthwhile to have legal certainty

The PSD leader defended this Thursday that the request for consecutive inspection of the euthanasia diploma, which must be reconfirmed in parliament on Friday, is a valuable opportunity to “have security and legal certainty”.

“For now it is not time to talk about it in final terms, because there is still no approved text and above all it is not yet a promulgated text and a text that is in our current legal system. seems to us, is an opportunity that can be worthwhile even if there is safety and legal certainty in our legal system “said Luis Montenegro.

The PSD president spoke to journalists in Ansião, Leiria district, as part of the “Sentir Portugal” initiative, after the party’s parliamentary leader said he would agree to a request for successive inspection of the diploma that euthanasia settles as a group of deputies social democrats move forward adding that this will not be done officially by the bank.

During the meeting of the PSD Group, which took place behind closed doors, Joaquim Miranda Sarmento informed the delegates that it was not the intention of the Group’s leadership to use this instrument of appeal to the Constitutional Assembly in that capacity. Court , but recalled that 23 deputies are enough (one-tenth) to do this.

The PSD chairman regretted that “the parties in the Assembly of the Republic, namely those who supported this amendment to the law, have not followed up on the message of the President of the Republic, namely, with regard to urging the Parliament not to to act hastily and to pay attention to the particular sensitivity of this theme”.

Noting that on the social-democratic bank “the deputies will express their opinion in freedom of vote, as is customary in these matters in the PSD”noted Luís Montenegro “They all have all the instruments the regiment has [da Assembleia da República] and grant the Constitution to them, on terms which they may, in a later manner, raise the sequential inspection of constitutionality”.

The Social Democratic leader added that he had a note that there are parliamentarians who have expressed this intention and explained that, “once the diploma is approved and, above all, if and when it is issued and enters into force, this matter will be reviewed by the deputies of the parliamentary group”.

“And basically I believe that if things stay as they are, the signatures needed for this can be collected.”he said.

When asked if it wouldn’t make sense for the bank’s leadership to move forward, the Social Democratic leader reiterated that this is an issue in which deputies have freedom to vote, so “it is natural that this assessment is also embodied in the same spirit”.

“But at least that does not mean that we do not also make our assessment, our assessment, whether the party leadership or the group leadership”he stated, adding, “I don’t think there’s a need to give that impetus in terms of direction.”

Luís Montenegro also guaranteed that the PSD will not establish contacts with other parties for this successive inspection, given that it “has more than enough delegates to raise this inspection” and whether this is a strategy not to comply join Chega in the request for Sequential Oversight replied that this “doesn’t have enough deputies to do some things under the terms of the constitution” and “has to comply and do it for life to have enough deputies in the future and don’t depend on others.”

“We, in the PSD, do not depend on anyone and we will not depend, let alone Chega,” he assured.

PS accuses PSD leader of “authentic zigzag”

The parliamentary leader of the PS, Eurico Brilhante Dias, this Thursday accused the president of the PSD, Luís Montenegro, of carrying out an “authentic zigzag” regarding the legislation on medically assisted death that the socialists will confirm.

Speaking to journalists in the Assembly of the Republic, the party chairman of the PS was asked about a possible request for a successive inspection of the constitutionality of the future law on the subject.

Speaking after a meeting of the parliamentary group of the PS, Eurico Brilhante Dias reiterated that the socialists will confirm the decree vetoed by the president of the republic and said that if there is a request for successive inspection – which according to the conditions of the Constitution can be drafted by one-tenth of the deputies, 23 of the 230 — “this is the normal functioning of the institutions.”

“But this is also quite demonstrative of Doctor Luís Montenegro’s authentic zigzag in this matter”considered.

The parliamentary leader of the PS noted that “Dr Luís Montenegro first, after a long legislative process, did not raise the issue of the referendum” and only later, “at the mouth of the vote for the first time in this legislature, already as chairman of the PSD he proposed a referendum”.

“And now, after the work done, the control, he comes to say that he is in favor of a successive inspection. It is the normal functioning of the institutions, but it is still a zigzag of Dr Luís Montenegro in this matter”he added.

The PSD parliament leader, Joaquim Miranda Sarmento, said this Thursday that he was available to be one of the signatories to a request for sequential inspection of medically assisted death legislation, although he stated that this initiative will not be officially promoted by the social group – Democrat.

On April 19, when he vetoed the parliamentary decree to decriminalize medically assisted death, the president of the republic, Marcelo Rebelo de Sousa, dismissed doubts about its constitutionality, pointing only to the parliamentary decree as “a problem of precision”.

The Assembly of the Republic should on Friday confirm the diploma vetoed by the President of the Republic on medically assisted death, an intention announced by PS, BE, IL and PAN, forcing its promulgation.

According to the constitution of the republic, despite a right of veto, the parliament can confirm the text with an absolute majority of the deputies in office, 116 out of 230, and in this case the president of the republic will approve the diploma within eight days after the date of receipt.
