The Government approves that the use of pyrotechnic devices in sport becomes a crime

The new Legal Regime for Explosives and Dangerous Substances (RJESP) was approved this Thursday by the Council of Ministers and now criminalizes the possession of explosives, articles or pyrotechnic devices in sports venues and other prohibited places.

In this context, according to the proposal of the Ministry of the Interior (MAI), a prison sentence of up to five years or a fine of up to 600 days is established for those who “incur in the transport, detention, use, distribution or possession of explosives , improvised explosive devices or pyrotechnics, in sports venues, fan meeting places and celebration of sporting successes”.

The use of explosive devices “in places intended for training and sports practice and in facilities of clubs and sports societies” also becomes a crime.

The bill, which will now be sent to the Assembly of the Republic, defines improvised explosive devices or “pyrotechnic articles” as prohibited items, which includes any device that contains explosive substances or “an explosive mixture of substances intended to produce a heat, light, sound, gas or smoke effect, or a combination of these effects”, including ‘very light’.

According to the AMI, this new legal regime, which revokes eight diplomas, “simplifies and implements a coherent legislative framework that reinforces supply chain information, control mechanisms at the time of sale, and transactions involving explosive substances.”

The Legal Regime for Explosives and Dangerous Substances approved today also establishes other changes, such as new validity periods for permits, which are no longer valid for 10 years, and mandatory professional training for operators of explosives, pyrotechnics, and auxiliary personnel (initiation , refresher and specialization courses).

The government bill also imposes mandatory civil liability insurance for the exercise of this activity, the existence of an administrative procedure manager, who will be in charge of expediting the process, and the electronic processing of procedures.

The new regime establishes “objective criteria to assess suitability, now omitted for explosives and pyrotechnics operators, a new classification for establishments in the sector (manufacturing, storage and disposal), ending the existing legal vacuum and a new classification of magazines and magazines, creating storage places suitable for the needs of the different operators”.

The bill also reviews the amounts and types of dangerous explosive precursor substances subject to a storage license, creates licenses for type one and two shipbuilders, depending on the type of explosive products they sell, with the figure of the reseller, and begins to accredit training entities and trainers.
