Disciplinary Council does not guarantee that clubs enter the field to learn sanctions

The Disciplinary Council (CD) of the Portuguese Football Federation (FPF) explained this Monday that it cannot guarantee that the clubs will enter the field to know the punishments of the previous matches, after the judicial decision on the suspension of Paulinho.

The CD, which until now has ensured that all the clubs enter the field knowing the penalties related to previous matches (holding, for this, several matches a week and publishing several weekly maps), will not be able, due to the understanding on deadlines set by the club and corroborated in court and based on the competition calendars, to ensure that this will continue to happen at all times,” the federative disciplinary body detailed in a statement.

According to the CD of the FPF, the new interpretation of the terms applicable to the abbreviated procedure “may also prevent the timely resolution of the appeals filed against the sanctions applied.”

The Sporting Paulinho striker was used as a substitute this Sunday against FC Porto thanks to the suspension of the suspension with the precautionary measure presented by the ‘leões’, after the striker was banned for three games after his expulsion in the final of the League Cup, which the ‘lions’ lost to the ‘dragons’, 2-0, in Leiria, on January 28.

The ‘lions’ appealed this sanction to the full FPF CD, before the visit to Rio Ave, for matchday 19 of the I Liga, without preventing Paulinho from serving the second game of the sanction.

Then, Sporting filed an appeal before the Court of Arbitration for Sport (TAD), together with a precautionary measure, which was granted by the Central Administrative Court of the South (TCAS), suspending the decision of the CD of the FPF, without However, without having evaluated the merits of the matter, as disclosed in this appeal instance on its official Internet page, without identifying those involved.

“Although the CD considers that the right of defense and hearing of a player whose club is notified, on January 30, 2023, at 09:37 a.m., until 12:00 a.m. the following day (that is, more than 26 hours later), a period of more than one day) to be able to say in writing, if you want, what you can offer about the facts present in the official reports on the game in which you intervened, and in that period nothing says or demands, the President Magistrate of the TCAS, in a precautionary measure, signed a different understanding, ”adds the federative body.

The CD of the FPF recalls that in July 2020, when the mandate began, the sports agents were summarily sanctioned without being notified of the game reports and without the right to defense and that it was on their initiative that “it was put in The new summary disciplinary procedure is underway, which guarantees access to the reports and the defense of what is reported in them”.

The objective was “to reconcile respect for the right of defense with speed”, so that in professional competitions the punishments would be known before the next day.

“In the current sports season alone, there were hundreds of summary sanctions in the Professional Section, and the CD always made sure that they were known to sports agents before the next game was played, despite the increasing number of games and their dispersal several days of the week,” he says.

Now, with the court ruling known, the CD of the FPF explains that equality must be guaranteed.

“This new interpretation, the result of a court ruling recently raised now by a club that intervened in the regulatory definition of the summary procedure (through self-regulation) requires, for reasons of equality, that from now on the same term be guaranteed to all sports agents. “, he emphasizes.
