Are we heading towards a “booba jurisprudence”? Already in the middle of a legal battle against the agent Magali Berdah who accuses him of cyberbullying -accuses him of defamation-, the rapper has also started a confrontation with Meta, the parent company of Facebook and Instagram.
In question, the deletion of several Instagram accounts linked to the singer and even the rapper’s banishment for life, decided by the American company. A “medieval” decision denounces his lawyer Me Gilles Vercken before Tech & Co.
The first case begins on January 20, 2020, when Instagram decides to suspend Booba’s official account and its 4.6 million subscribers. “A story of buttocks”, ironically justifies the artist, referring to the dissemination of intimate videos starring the rapper Fianso and a woman. But for Instagram, it is a violation of the rules of use.

The account finally returned in February before being closed again in December of the same year. “We have also now permanently removed @boobaofficial, the Booba fan account run by his teams, after he broke these rules on multiple occasions,” Meta told HuffPost. He had returned to settle scores with his rivals.
Booba then turned to other accounts linked to his promotion, including @lapiraterieofficial and @OKLM. But both will be closed by Meta: in January for the first, after a legal protection demanded by the influencer Demdem. The second in July 2022: Magali Berdah announced that she had obtained the judicial closure of this account “with which Booba encouraged her herd almost daily to act against me” according to her.
At the same time, Booba goes on trial against Meta. And he gets a first win in October 2022 with a Justice decision so it is illegal to delete your Instagram account @OKLM.
A judicial decision that Meta did not want to apply, which had refused to reactivate the account. “The OKLM account was deactivated in application of our recidivism policy and because the content of the OKLM account had repeatedly violated the rules of the Instagram service,” the platform assured Tech&Co.
The same consequence for the @lapiraterieofficial account, when the president of the Marseille court recognized the order to close the account as “null and void” for lack of contradictory debate.
The file will now acquire a broader dimension: in July, a court must decide whether it is indeed the French court that has jurisdiction in this file or the Irish court, as Meta (the company with European headquarters in Dublin) affirms. A decision that perhaps draws the first lines of a jurisprudence on the responsibilities of social networks now called to be justified.
