Apple Watch: ban on sales of Apple connected watches lifted during appeal procedure

Apple will be able to put its Apple Watch Series 9 and Ultra 2 connected watches on sale again. The ban is lifted while the US appeals court rules on the patent infringement case.

A US federal appeals court on Wednesday, December 27, suspended the ban on sales in the United States of several models of Apple’s connected watch, accused of having violated the patents of a medical device manufacturer.

This ban went into effect on Tuesday, December 26 after Joe Biden’s administration chose not to veto a decision by the US International Trade Commission (ITC).

But Apple believed the US body was wrong and stated at the time that its decision should be overturned and that it was willing to take legal action.

A suspension during an appeal procedure

Apple announced on Tuesday, December 26, that it had filed an appeal in federal court. It decided on Wednesday, December 27, that the ban would not apply until the appeal procedure was completed.

Apple announced on December 18 suspension of sales in the United States The Apple Watch Series 9 and Apple Watch Ultra 2 watches, to “respect the decision if confirmed,” a spokesperson for the group explained to AFP. These watches were no longer available from December 21 on the Apple website and from December 24 in stores.

Contacted by AFP, Masimo did not want to comment on this news. Apple did not immediately respond to requests.
