Personal data: the CNIL calls the Ministries of the Interior and Justice to order

The CNIL notes inaccuracies in the information kept by the authorities in the criminal record processing file.

The CNIL, the data protection watchdog, announced on Wednesday, November 6, that it had “called to order” the Ministries of the Interior and Justice for their “poor management of the criminal record processing file” (TAJ).

The file contains information related to victims of crimes and defendants in judicial proceedings. Particularly accessible to the police, it must be updated periodically based on the development of cases before the courts.

“Concrete and serious consequences”

The National Commission for Information Technology and Liberties stated in a statement that it had observed “several deficiencies related to the conditions under which personal data appearing in the TAJ are processed” and noted the retention of “incomplete” or “inaccurate” data. . , due to the lack of transmission of certain information by the prosecutor’s offices.

“This absence can have concrete and serious consequences for people, in particular because it can influence the conclusion of administrative investigations prior to the exercise of a profession or the admission to sit for a competition for public service,” continues the CNIL.

The authority also highlights the lack of information for victims or accused, who are not always informed of the existence of this file, and points out difficulties in the right of access to this information by the interested parties.

The concerned authorities have until October 31, 2026 to comply.

Asked by AFP, the two ministries did not immediately react.
