While Justice has recently decided in favor of the Arcom, validating the blockade of a pornographic site in France, two others are currently in the media regulator viewer. The authority revealed, this Tuesday, April 22, after having submitted two adult sites, a formal notice to comply with the Criminal Code. This, without naming them.
The arc, which can claim the begging of these sites thanks to the SREN law that is called the SO adopted in May 2024, their accusation of not having established an age verification system to prevent minors from accessing their content.
In his press release, he remembers that he sent “observation letters” to the providers of five services that allow minors to access their content without age verification on March 6. But, among them, the two interested parties continue to do so, so they were taken into account to fulfill their obligations.
15 days
The suppliers of these two sites now have 15 days to establish an age verification system, as provided in the law. “Yes, at the end of this period, said age verification system has not been implemented, the ARCOM can request its blockage and deference or pronounce pecuniary sanctions,” said the regulator.
With respect to the other three sites to which he sent observation letters in early March, the authority said he had not sent them a formal notice because they had established an age verification system. However, it is related to them to make sure they are effective. Pornographic sites are subject to the Arcom Reference Framework, published last October and according to which their age verification system should not only be reliable, but also offers a certain degree of privacy protection.
