New bastion against Deepfake’s dangers. The Danish government has announced that it wanted to strengthen its copyright legislation. Revealed by The Guardian, this measure responds to the appearance of the deep (or hyperructuring), these imitations of the people generated by AI from an image or a sound.
With a quasi-contracted among the Danish elected officials, a modification of the Intellectual Property Law could arrive this summer. Therefore, this change will grant each Danish citizen the right to give or not access to their image (face, body) and their voice, in the same way that an artist has copyright about his works. In particular, it will apply to platforms that use generative.
A pioneer text in Europe
If a person realizes that his face, body or voice were used by an online platform without their consent, the law would facilitate the elimination of these data, at the request of the victim. If the platforms are resistant, Jakob Engel-Schmidt says that he is ready to “take additional measures”, or even apply “severe sanctions” in case of breach of the law.
Such text is a pioneer in Europe. A first deployment in Denmark could be a precursor to an extensive establishment in the countries of the European Union. In any case, it is the will shown by the Danish culture minister. Copenhagen will occupy the presidency of the Council of the European Union as of July 1, 2025, enough to guarantee a potential trampoline to evoke the measure with other countries.
Deepfake is a problem taken more and more seriously by governments. This technology is at the origin of many cases of harassment, in particular because it allows the generation of sexual videos. Hyperructuring also facilitates fraud campaigns, increasingly sophisticated and convincing.
