In a fifty pages report, the Senate highlights the “threats” created by generative artificial intelligence on creation.

Lleeping almost three years ago, Chatgpt became an unmissable moment. Openai’s artificial intelligence has mainly launched a massive looting movement of many cultural elements. This is what a Senate report, carried by Senators Agnès Evran, Laure Darcos and Pierre Oozoulias, he says.

For several months, they conducted audiences and surveys to understand the impact of this technology on the world of creation, and today reveals several proposals.

Ai giants that use failures

Throughout a hundred pages, we discover how technological giants, including OpenAi and Google, use European and national legal failures and unemployment to do without the copyright rules.

Most of them use the exceptions contained in the 2019 directive, which authorizes them to loot “massively”, write senators, cultural works. According to these companies, the training of AI in content protected with content is possible in the context of academic research. Like the appointments that, therefore, it is possible to distribute or use, digital giants such as Operai, Microsoft and Google, report the “fair and reasoned” use of the works.

A very specific interpretation of a directive that, therefore, must be improved.

In the report, the Senate wishes to implement nine recommendations. First, it is a matter of the remuneration of the beneficiaries. When an AI takes content that comes, for example, artists, media or cinema, it is necessary to ensure that a fair exchange of income can be negotiated. The Senate also requires greater transparency by technological giants when the content is used to train its artificial intelligence.

Towards a “AI tax” similar to “transmission tax”?

Above all, senators want France to develop a sufficiently wide and diversified database so that AI can use it without restriction. This would be the issue of harsh negotiations to fix the training conditions and the work that would be stored there.

However, it remains to be seen how such a project can see daylight. As such, there is a question of consultations, such as what is done when it comes to media chronology, which establishes periods of dissemination between cinema and platforms such as Netflix or Canal+. In the event that no one may agree, for the fall of 2025, the Senate demands its wishes to the vote of a law to create “a presumption of use of cultural content by AI.

If nothing is done, the report also wants to establish “a billing imposition” on what technological giants achieve in France. As with musical transmission platforms, this would indirectly finance the cultural environment, and perhaps limit the abusive uses of AI.
