Death of Jean Pormanove: The Paris Prosecutor’s Office announces the opening of an investigation against the Kick platform

This investigation, inaugurated on Monday, was initiated by the Office of the Prosecutor of Paris, in consultation with the Nice Prosecutor’s Office that had opened two investigations to determine the causes of the death of the content of the content.

Violations of suspicions of obligations

This preliminary survey, “of the head of the organized online platform, the organized gang” aims to determine “if the kick platform provided unlawful services to know, in particular by the dissemination of voluntary damage videos to the integrity of the person.”

The Paris Prosecutor’s Office also wishes to determine if the platform has fulfilled its obligations, particularly in terms of reports to the “risk of damage to the life or safety of people.”

For the latter, the public prosecutor informs that a possible violation of this obligation can be synonymous with criminal procedures and can be repressed with a “maximum sentence of 10 years in prison and a fine of one million euros when it is committed to an organized gang.”

A minister also attacks the kick

At the same time, the minister delegated by Digital, Clara Chappaz, on Tuesday announced his intention to attack in the Court for “violating” the kick of the Australian platform.

“Kick did not do everything possible to end the dissemination of the content that was dangerous,” the minister justified, after a meeting called to Bercy with the services of several ministries and two independent authorities, accusing Kick for having broken the 2004 digital trust law.

Died during live broadcast

Raphaël Graven, known by Jean Pormanove’s pseudo, died during a live broadcast in Tales, near Nice, on August 18, after more than 12 days of life that showed him, as well as another man, abused and humiliated by two other people.

Thursday, the prosecutor of the Republic of Nice said that The autopsy had excluded “the intervention of a third”namely that the two forensic doctors had not noticed “traumatic injuries.” The causes of death, “of medical and/or toxicological origin”, remain to be determined.
