Two American writers assigned Apple to California on Friday, accusing the American giant of having used pirate books to lead to artificial intelligence (AI) models integrated into their devices.
This procedure was launched a few days after Anthrope, a powerful new American company of the AI, agreed to pay the colossal sum of at least 1.5 billion dollars to compensate for the beneficiaries who chased her for illegally downloading millions of pounds.
“Clandestine libraries” for Apple?
“To train the generative models that are part of Apple Intelligence, Apple gathered for the first time a large data library,” explain the authors in their application.
According to them, “part of these data includes protected works that have been copied without the consent of the authors, without accrediting and compensating them,” write Gray Hendrix and Jennifer Roberson who want their resource to become a collective.
The two writers believe that their books are part of this “scratched” content by Apple in “clandestine libraries.”
Apple, united by AFP, did not react immediately.
AI faced its repeated flights of protected content
Many other files are ongoing in progress in US courts, initiated by writers, musicians or press editors for unauthorized use of their production in AI development, which requires the absorption of phenomenal data.
To defend themselves, most of the main actors in the generative AI trust the legal concept of fair use (“fair use”), which probably limit the application of intellectual property right.
In the case against Anthrope, Californian judge had considered that feeding a generative the AI program with protected works was fine in fair use.
But he had recognized the company, mother of AI Claude’s model, guilty of having downloaded and storing books of pirate bookstores instead of buying them.
On the contrary, another Californian federal judge agreed in June to Meta, the Facebook parent company, while explaining that the plaintiffs, to win, could have raised other admissible arguments: for example, that AI, using writers of writers, created a powerful tool that can allow a multitude of users to compete in the literary market.
