End of shared accounts on Netflix: Deco rejects violation of consumer rights

As of this Wednesday it is final: Netflix prohibits sharing passwords between users who do not reside at the same address as the subscription holder.

Anyone who now wants to add a user away from home will have to sign up for a Standard or Premium plan and pay an additional €3.99 to associate a new user to their account.

For the deco jurist Luís Pisco, heard by the TSFfrom the beginning this change does not raise legal problems.

It may even be “a violation of consumer expectations, but not of contracts,” he notes. “This is because the subscription to Netflix is ​​made monthly, there is no type of loyalty and consumers can cancel the service from the following month.”

As there is “a prior notice” that allows users to cancel the service if they do not agree with the changes, “there is no violation of consumer rights,” he explains.

Luís Pisco acknowledges that some complaints or requests for information on this issue have reached the consumer defense association.

“Deco has received requests for information from people outraged by the change in the exchange model, but that’s about it.” There are only two hypotheses: resign and accept the changes in the Netflix rules or stop being a customer.

TO TSF He also contacted the National Commission for Data Protection to find out whether or not there may be possible violations, but so far he has not received a response.

This is because under the new rules, users must associate their primary location with their account and let Netflix know where they are.

Access outside of that location is prohibited, with one exception that also requires location control: it is possible to access the streaming service outside the home, in a hotel room or vacation home, for example, but the Netflix application must be Open on a mobile device that is connected to the main location’s Wi-Fi at least once a month.

According to the updated price list, the streaming service now costs €11.99 per month for the Standard plan and €15.99 per month for the Premium plan, plus an additional €3.99 for each new user. The cheapest plan is the Base, it costs 7.99 euros per month but it does not allow you to associate users outside your home.
