With the possibility of offering dematerialized receipts, will businesses also be able to send advertising? As of April 1, 2023, the printing of the receipt will no longer be systematic. The aim is, in particular, to fight waste and reduce the environmental impact of receipts.
Therefore, merchants will have to give customers a choice between requesting a paper printout, not taking their ticket or receiving a dematerialized receipt (in particular by SMS, email or by scanning a QR code), or digital. However, the law does not require merchants to offer this option.
In the case of dematerialized delivery of the ticket, “solutions that require the collection of the least amount of personal data will be favoured. They must, in any case, respect the GDPR and the LOPD”, warns this Friday the National Information and Liberties Commission (Cnil ).
Consent not required for existing customers
Regarding the reuse of data for commercial prospecting purposes, “advertising by electronic means (email, SMS, MMS, fax, etc.) is possible as long as people have given their explicit consent before being surveyed”, it indicates the CNIL.
“However, if the prospected person is already a customer and if the prospecting refers to similar products or services provided by the same company, prior consent is not required,” specifies the independent administrative authority. “In this case, the Cnil considers that the legitimate interest can constitute a valid legal basis.”
Finally, the Cnil warns that “people must be informed and put in a position to oppose this use in a simple and free way at the time of data collection and at any time, in particular when sending a prospecting email “.
