Deputies and senators reached an agreement on Thursday to better regulate the influencer market, paving the way for the final approval by Parliament of this cross-party proposal by deputies from the PS and Renaissance.
The text will allow “rebuilding a bond of trust between society and influencers after so many years of excesses”, promised the socialist Arthur Delaporte, praising the unanimous adoption of the joint joint committee (CMP), after two unanimities at first reading in the National Assembly and in the Senate. The elected socialist leads this text with the related deputy Renaissance Stéphane Vojetta.
Ending the law of the jungle
The sector has been the subject of strong criticism in recent months, between collective actions by people who believe they have been defrauded, a damning study by the General Directorate of Competition, Consumption and Fraud Prevention (DGCCRF) and attacks on the rapper’s social networks. Booba. against the potato of the influencers Magali Berdah.
To put an end to the law of the jungle, the text proposes to legally define influencers as “natural or legal persons who, in exchange for a fee, mobilize their notoriety with their audience” to promote goods and services online.
It provides for prohibiting the promotion of certain practices, such as cosmetic surgery, or “therapeutic abstention” (the act of encouraging people to abandon treatment). Bans or severely regulates the promotion of various medical devices.
The profession of “influencer agent” will also be supervised
Remember the submission to the Evin law and prohibits the promotion of products that contain nicotine. It will prevent influencers from promoting subscriptions to sports forecasts, and will only allow the promotion of gambling and betting on platforms that allow access to videos to be prohibited to minors.
It prohibits staging with animals whose possession is prohibited in France, with the exception of certain promotions, for example for zoos.
In case of non-compliance, it provides for penalties of up to two years in prison and a fine of 300,000 euros. The work of “influencers agent” will also be regulated. The written contract will be mandatory when the sums in question exceed a certain threshold.
To reach influencers who operate from abroad, in Dubai for example, the text requires those who operate from outside the EU, Switzerland or the European Economic Area to take out civil insurance in the EU to compensate victims. They will also have to name a legal representative in the EU.
