Deceptive practices: two influencers forced to publish injunctions of the Repression of scams

On Instagram, Illan Castronovo and Simon Castaldi publish a message from the General Directorate for Fraud Prevention. These publications follow an administrative mandate.

“I made three mistakes”

The two influencers thus see their practices sanctioned by an administrative protection. The DGCCRF criticizes Simon Castaldi for not having indicated “the commercial intention” of certain publications as well as “the brands for which he makes these communications”.

For his part, Illan Castronovo is accused of not showing commercial intentions. The influencer is also under fire for claiming that a sports betting advisory service “increases the chances of winning at gambling.” Finally, a third point mentions the presentation as lawful of “a service for the payment in money of a part of the balance of the personal training account (CPF) in exchange for a simple registration in a training course”.

After the DGCCRF injunction was posted online (which will remain posted for 30 days), Illan Castronovo explained it on Story. He points out that he was present on social networks for seven years and that he stopped placing products two years ago.

50 influencers reviewed

The influencer thus evokes “a lack of seriousness” in the indication of paid associations that he has sometimes forgotten. It also returns to the other two criticisms made by the DGCCRF. “I made these three mistakes, which I recognized and which I assume,” he affirms, indicating that the supervision of environmental practices seemed “very good” to him.

At the beginning of May, the Repression of Fraud announced that it had controlled 50 influencers during the first quarter of 2023. Among them, 30 had committed crimes, Bruno Le Maire announced, specifying: “We give the names.”

During this announcement, the DGCCRF had specified that the controls would give rise to 18 precautionary measures and 16 criminal complaints. But for now, only the accounts of Illan Castronovo and Simon Castaldi seem to be in the spotlight. Contacted by Tech&Co, the DGCCRF has not yet provided details about these messages.
