Angolan electoral commission asks the Constitutional Court to reject UNITA’s appeal

The Angolan CNE asked the Constitutional Court (TC) on Monday to reject the contentious appeals of UNITA, the Democratic Bloc (BD) and the CASA-CE coalition, “due to lack of evidence and legal support”, and validate the final results of the elections.

The position of the National Electoral Commission of Angola (CNE) is contained in its counterclaims approved today by the body’s plenary session during its 33rd extraordinary plenary session, which made an in-depth analysis of the two electoral dispute appeals that are in the TC.

“In theory, the plenary asks the Constitutional Court not to grant them due to lack of evidence and legal support, as well as the material impossibility of the requests formulated therein”said CNE spokesman Lucas Quilundo.

“In the present case of the request of UNITA (National Union for the Total Independence of Angola) and the BD, which joined efforts to submit this contentious appeal to the TC, the plenary concluded the analysis of the various elements involved in the process that The request was based on evidence that is not consistent with what was alleged,” he said.

According to Lucas Quilundo, UNITA and BD supported their allegations with a set of copies of tabulation records at the polling stations, when they had to resort to copies delivered by the CNE to the list delegates.

“It can be seen from these documents, along with the process, that many of them are devoid of the identification codes of the voting tables, in some situations these copies are repeated”plot.

Quilundo also mentioned that many of the documents presented as evidence by UNITA and the BD presented “clear indications” of deletion: “And for these reasons they could in no way be considered for the purposes of supporting their requests.”

“That is why the plenary session of the CNE, at the conclusion of its arguments, asks the TC not to accede to this request,” he stressed.

Last week, UNITA and CASA-CE filed appeals related to the electoral process before the Constitutional Court, none of them related to the annulment of elections, the institution reported today.

“The court received late yesterday afternoon [quinta-feira] two complaints, two requests that open the electoral dispute, one from UNITA and the other from the CASA-CE coalition,” said court spokeswoman Aida Gonçalves.

UNITA demands that the CNE compare the records of the polling stations in its possession with the records held by the parties, objecting that the authorities did not even indicate the data related to the polling stations, which allowed the final accounting.

In relation to the CASA-SE request, Lucas Quilundo continued, “it suffers from similar defects with the copies of the minutes and not with the copies delivered to the list delegates by the CNE and posted at the polling stations.”

“There is still a need to verify the repetition of the minutes, as well as the presentation of the minutes of the polling stations, which for the purposes of calculating the result are not legally qualified documents that must be the recapitulative minutes of the polling stations,” he stressed. .

For these and other reasons, he pointed out, “also with minutes of illegible content, and the plenary session also concludes its counter-allegations asking the TC not to accede to these requests and, consequently, validate the final results of the elections released by the CNE”.

The plenary session of the CNE did not consider today the request of the Mudei civic movement, but, the commissioner observed to the electoral body, “it will have to be done next time.”

The CNE announced, a week ago, the final results that gave victory, by absolute majority, to the Popular Movement for the Liberation of Angola (MPLA), a result disputed by UNITA.

The president of the CNE, Manuel Pereira da Silva, proclaimed the winners to the Popular Movement for the Liberation of Angola (MPLA) and its candidate, João Lourenço, with 51.17% of the votes, followed by UNITA with 43.95%.

With these results, the MPLA elected 124 deputies and UNITA 90 deputies, almost twice as many as in the 2017 elections.

The Broad Convergence for the Salvation of Angola – Electoral Coalition (CASA-CE), the APN and the P-Njango did not obtain seats in the National Assembly, which in the 2022-2027 legislature will have 220 deputies.
