Death of two French children in Gaza at the end of 2023: Israel attacked in Paris for a complaint about genocide

A complaint against X for murder and genocide was presented this Friday, June 6 in France by a grandmother accusing Israeli authorities for being responsible for the death of their two French grandchildren in Gaza in October 2023.

This complaint with a constitution of the Civil Party, on Friday announced to the AFP by lawyer Arié Alimi and appeared at the Crime Pole against Humanity of the Court of Paris, aims to obtain the appointment of a investigative judge. The Human Rights League intends to join it.

The French nationality of the victims could trigger the direct jurisdiction of French justice and make it to decide on these accusations of “genocide”, categorically rejected by Israel as “scandalous”, while at this stage, legal initiatives in France in this sense have not prospered.

Two missiles thrown by the Israeli army

The complaint refers to the death of Janna and Abdrahim Abudeaher, who was then 6 and 9 years old, in a house in the north of the Gaza Strip “beaten by two F16 missiles retired by the Israeli army”, on October 24, 2023, 17 days after the unprecedented attack against the Palestinian Movement Hamas on the Israeli soil.

The 48 -page complaint is presented by Jacqueline Rivault, the child’s maternal grandmother, for murder, crime against humanity, genocide and complicity of these two crimes.

According to the complaint, the “extreme violence” and the “regular bombings” of the Israeli army in Gaza after October 7 led the family to leave their apartment on the night of October 22 to take refuge in another family home and then a school.

Finally, they would have been affected by two missiles in a new house “north of the Gaza Strip, between Fallouja and Beit Lahia”, one of them entering “through the roof and the second directly in the room where the family was.”

Abdrahim died “instantly”, and Janna shortly after his transfer to the hospital, according to the complaint. His brother, Omar, was seriously injured but still lives in Gaza, like his mother, Yasmine Z.

An arrest warrant against the mother of the victims

Also injured, she was sentenced in 2019 in her absence in Paris for financing terrorism for having distributed money in Gaza to the members of the Jihad and Islamic Hamas between 2012 and 2013. It is led by an arrest warrant.

Requested by AFP several times in the past on the case of these two children, the Office of the Anti -Terrorist prosecutor had last responded at the end of 2024 not having opened an investigation.

The complaint advances the qualification of the genocide because this bombardment is presented as part of a project aimed at “eliminating the Palestinian population and subjecting it to conditions of existence that probably cause the destruction of their group.”

The complaint appears against X, but points to his name, Prime Minister Benjamin Netanyahu, the Israeli government and Tsahal.

Three complaints in France

Israel faced a growing international pressure to end the war that devastated Gaza, launched on October 7, 2023 by Hamas and led to the death of 1,218 people on the Israeli side, mostly civilians.

In return, Israel launched a military reprisal campaign that killed more than 54,600 Palestinians, mainly civil, according to data from the Hamas Government Ministry of Health for Gaza, considered reliable by the UN.

Benjamin Netanyahu and former Defense Minister Yoav Gallant are attacked by an arrest warrant of the International Criminal Court (ICC) for crimes against humanity and war crimes.

The International Federation of Human Rights was the first in December 2023 in affirming that Israel received a genocide, followed by Amnesty International a year later and Human Rights Watch (HRW).

In January 2024, the International Court of Justice (CIJ) called Israel to avoid any act of genocide. The UN Humanitarian Operations Chief also urged world leaders to “act to prevent a genocide” in mid -May. A certain number of legal actions have been carried out in relation to this “genocide” attributed to Israel, for example, in Switzerland, the Netherlands or even in Germany.

Three complaints have been filed in France in recent months against members of Franco-Israelí associations or a Tsahal soldier, accused of genocide or complicity.
