The grandmother of two French children who died in Gaza in 2023 explains that she has filed a complaint against Israel for the genocide, a first, because she felt a “duty” in front of them, this Friday, June 6 before the press in Paris.
“I felt a memory duty, I didn’t want them to be forgotten,” explains Jacqueline Rivault, with emotion.
Janna, 9, and Abdrahim, 6, called “Obeida” by his grandmother, died after being attacked by the Israeli army fire on October 23 to 24, 2023 in Gaza. According to Jacqueline Rivault, the boy “dies instantly”, while the girl dies from her wounds after several months in the hospital.
“They would have deserved a life”
Jacqueline Rivault explains that her complaint represents “many things for children, for their memory.”
“They would have deserved a life, they were very young,” he said, considering “that he has not left them the choice, except to be killed in unbearable circumstances and leave Yasmine my daughter and Omar to his brother very seriously injured and psychologically affected.”
Currently, Yasmine, also affected in the strikes, is still seriously injured, while doctors have discovered that “another missile fragment that moves to the femoral artery.”
The third son of Brothers, Omar, two and a half years at the time of events, survived the shooting. If it is “much better” today, it is marked by this episode. At the age of five, “he does not understand that he will not see his brother and sister again,” laments Jacqueline Rivault. Parents and Omar are currently in a secret place for their safety.
“Time” to succeed in overcoming “pain”
The children’s grandmother explains that she took a long time to file a complaint due to her “pain”, after the death of two of her grandchildren.
“It took me many months to spend this course,” he said. “Losing two children at the same time and also devastates it violently. I didn’t want to believe it.”
From now on, it also presents a complaint partly for your daughter. “Yasmine does not want, he cannot file a complaint for her safety. She fears for her safety, her husband, Omar and her mother -in -law,” explains Jacqueline Rivault.
Grandma judges the responsible Israeli army
For Jacqueline Rivault, this complaint about voluntary homicide as a crime of war, crime against humanity and the crime of genocide was necessary, because it considers that Israeli authorities have a responsibility in the death of their two grandchildren.
“The Israeli army, the day after October 7, entered the Gaza Strip and began bombing and killing, especially civilians,” said the grandmother.
To the question of whether the family has been voluntarily attacked, the grandmother replied: “It could say it, because many people have been deliberately attacked, when the number of Palestinian journalists killed and bombarded hospitals has counted.”
For her, these strikes would be explained “because (Yasmine) had a humanitarian action.” “Humanitarian workers have been systematically attacked,” says Jacqueline Rivault.
Netyahu attacked in the complaint
“If a legal complaint filed in France by a grandmother can have the impact of launching international arrest mandates against all those who can in one way or another being accomplices or authors of these facts, then there will be a political deterrence,” he waits before the press, Jacqueline’s lawyer Rivault Me Arimi.
“We really think that with a simple complaint filed in France, we strengthen the international legal order, the international criminal order fractures,” he said.
“We can see that despite the decisions of the International Court of Justice, despite the arrest orders launched by the International Criminal Court, there is no cessation of this ethnic cleaning (in Gaza),” he said.
The complaint appears against X, but aim is Prime Minister Benjamin Netanyahu, as well as the members of the Israeli government, as well as Tsahal.
Israel faced a growing international pressure to end the war that devastated Gaza, caused by the attack on October 7, which resulted in the death of 1,218 people on the Israeli side, mostly civilians.
In return, Israel launched a military retaliation campaign, which went through mass bombings and land struggles, which killed more than 54,600 Palestinians, mainly civil, according to data from the Ministry of Health of the Hamas Government for Gaza, considered reliable by the UN.
