War in Ukraine: Russia condemned for multiple human rights violations by CEDH

Russia is remarkably declared guilty of executions of “civilians and Ukrainian soldiers out of combat” or “acts of torture” by CEDH after a deliberation read this Wednesday, July 9.

The European Court of Human Rights (CEDH) condemned Russia on Wednesday, July 9 for multiple human rights violations that occurred during the operations carried out in Ukraine in 2014 in DonBass, of the War since February 2022, and for the destruction of flight MH17 in July 2014.

At the end of a deliberation read for more than 40 minutes by the president of the Court, the French judge Mattias Guyomar, Russia, is declared guilty of executions of “civilians and Ukrainian soldiers out of combat”, “acts of torture”, “unjustified trips of civilians” or even “destruction, inauguration and expropriations”.

“The state of the defendant must without delay or refer safely to all the people who, in the Ukrainian territory occupied by the Russian forces or under Russian control, were deprived of liberty (…) and who are still detained by the Russian authorities,” said the ECHR, who is in Strasbourg.

Russia “must bring without delay”

The latter also considers that Russia “must provide its cooperation without delay in the implementation of an international and independent mechanism aimed at guaranteeing, as quickly as possible and taking into account the best interests of children, the identification of all children transferred from Ukraine to Russia or the territory controlled by Russia.”

The decision was taken by the CEDH Grande Chamber, its most solemn training composed of 17 judges.

This was joined in this same decision three complaints filed by Ukraine against Russia after the operations were carried out in 2014 in the DonBass and the war launched in February 2022, and another complaint of the Netherlands for the destruction of flight MH17, an Amsterdam party to Malaysia on July 17, 2014, demolished by a myilla in the Donetsk region in Donetsk in Donetsk Donetsk, in the Donsk region, in the DonBass, already Malaysia to Malaysia, and that had been transferred by a myilla in the Donetsk region, in the Donetsk region, in the Donsk region, in the Donets region, in 298888.

Russia is no longer part of the European Human Rights Convention since September 16, 2022, as a result of aggression against Ukraine, began a few months earlier.

But it is still responsible for the violations of the fundamental rights committed before this date. However, this condemnation of Russia has a symbolic character above all: since September 2022, Moscow no longer gives any sign of life before CEDH.
