Alina Habba stated that Trump was entitled to have “declassified” files — that is, already removed with secrecy — as a personal memento of his tenure and added that the allegations are politically motivated, making an argument by the Republican himself repeated.
“He has every right to have confidential documents that have been released,” Alina Habba told the Fox News Sunday program, broadcast by Fox News, two days before Trump appeared in federal court in Miami (southeast).
Trump, who is seeking the Republican nomination to run again in the 2024 presidential election, will face 37 charges in court Tuesday, including violations of the Espionage Act, false statements and conspiracy to mishandle confidential material. .
For Habba, this whole legal plot has an “entirely political motivation”. “It’s clearly election interference,” he said, referring to alleged obstacles to Trump’s candidacy. Habba also described the Republican’s opposition to federal agents searching his boxes during a search of his home in Mar-a-Lago, Florida, noting his frustration that officials were going through his personal belongings.
“He has every right to possess secret documents that he himself has released… Things that are souvenirs, things that he is allowed to take,” he stated.
“The president’s ability to classify and control access to national security information is enshrined in the Constitution,” House Judiciary Committee chairman Jim Jordan, a close ally, also told CNN.
According to him, the former president can put this material “where he wants, (…) treat it as he wants”.
However, the United States Attorney General during the last year of the Trump presidency (2017-2021), Bill Barr, has already admitted that his former boss is facing “harsh allegations” from the Justice Department and that he has no victim of a witch hunt, as the tycoon insists.

The charges against Trump, filed by Justice Department special counsel Jack Smith, each face up to 20 years in prison.
