United States: Burger King is the subject of a complaint for deception about the real size of its Whopper

The fast food chain is the subject of a collective action that accuses it of presenting its famous hamburger 35% larger than it really is and, in particular, with twice the amount of meat.

This is the traditional criticism leveled at fast food chains: the sandwiches they serve do not look like the ones in their advertisements or even in their restaurant photos. And this type of criticism even ends up in the legal field on the other side of the Atlantic. As the BBC mentions, Burger King has just been added to the list of fast foods that are the subject of legal action for “misleading advertising” in the United States.

An American judge has decided to initiate a lawsuit and, therefore, follow up on a class action lawsuit filed against Burger King, which estimates that the real size of the famous Whopper sandwich is 35% smaller than that of the different supports that represent it. In the images, the complainants point to ingredients that “overflow the bread” and, in particular, point to a dose of meat twice that of what is actually served to customers.

“False” Claims According to Burger King

Burger King defends itself before the BBC saying that “the claims of the complainants are false.” The brand had previously argued that it was not required to serve burgers “exactly as pictured.”

If district judge Roy Altman indicated in his decision to vote laisser aux jurés le soin de “dire ce que des personnes raisonnables pensent”, he would likewise reject the allegations selon lesquelles Burger King aurait induit les clients en erreur par ses publicités télévisées et online.

Burger King is not the first brand affected by these types of accusations. Last year, a New Yorker filed a class action lawsuit against the McDonald’s and Wendy’s chains, which he accused of unfair and deceptive marketing practices. Again, the lawsuit estimated that the two brands’ burgers were at least 15% larger in marketing images than in reality. More recently, Taco Bell was sued in the United States earlier this year for selling pizzas and wraps that allegedly contain half the advertised topping.
