A bill will be presented to prohibit the covered and plastic plastic plates reusable in school canteens, after a “confusion” introduced by a decree of implementation, the Minister of Ecological Transition, Agnès Pannier-Runacher, announced on Tuesday, March 18.
Promulgated in 2018, the Egalim Law had established for January 1, 2025 the prohibition “of the containers of kitchen, heating or plastic service” in the school and university dining rooms, as well as in the reception establishments for children under 6 years.
The prohibition had been extended by the Antigaspillage Law for a circular economy (AGEC) to pediatric, obstetric and motherhood services, also since January 2025.
“The law dates from four years ago. […] The legislator has changed his mind, the company goes beyond today, the associations, the mayors have mobilized telling us ‘we no longer want plastic’. Prohibit “all in plastic”
The minister explained that “the decree of implementation of the law was beyond the law, covered the prohibition of dishes and cutlery. At first, to “correct this”, the Ministry of Ecological Transition had decided to prepare a new decree project that provided to replace the words “the service or consumption of the dishes, including dishes and cutlery” by simply “the service.”
“The law gave a prohibition that was not in the end and that was ambiguous. The decree (initial, editor’s note) has prohibited everything, but the decree cannot be more ambitious than the law. This bill will come “as quickly as possible, and during this time I no longer need to modify the decree, we will adapt the law to the decree,” said Agnès Pannier-Runacher.
The initially planned government decree project is still available on the website of the Ministry of Ecological Transition. It could be “the issue of observations” until March 14, and among the comments, 14,852 to date, many Internet users declared themselves scandalized by the fact that plastic cutlery and plaques were not prohibited.
