Justice has decided: invalidates the Auchan Safeguard Plan (PSE). This social plan that provides 2,389 employment cuts in Auchan, concluded in March between the company and several unions, was invalidated by the Lille Administrative Court, announced this last Tuesday in a press release.
The Administrative Court considers in particular that the PSE, concluded at the group level, “should have been signed by the union representatives of each of the five components of the group”, and that the procedure for the information and consultation of the social and economic committees was fogged by a “procedure defect.” The decision does not increase the reintegration of dismissed employees.
If most of the union organizations had signed the agreement with the distribution group, the CGT shops Federation, as well as the members of the company’s social and economic committee, had attacked the agreement. According to these opponents, the agreement had not been subject to the multiple interested companies.
Last March, the CFTC, which is the majority union within the group, joined the CFDT and the CFE-CGC to allow the adoption of PSE that includes the elimination of 2,389 stations.
The CFDT even congratulated this agreement in a press release that provides support and measures of legal and supralegal compensation that can reach the twelve months of salary depending on antiquity.
