The decision could set a precedent within Grand Frais stores. The Solidaires-SUD union has initiated proceedings against Prosol, the group behind the food brand, before the Lyon social justice court. At issue: the absence of elected personnel in grocery stores.
To understand this, it is necessary to be interested in the particular structure of Grand Frais since the sign is not a company but a group of economic interest (GIE). “Within the stores, each department is attached to an independent company,” explains the regional secretary of the SUD Commerces et Services union, Frédéric Leschiera.
The butcher shop is often linked to the Despi group, the grocery department to the Bahadourian group, the bakery is attached to the Marie Blachère group. As for the fruit and vegetable departments, they are managed by the Prosol group, created by Denis Dumont, the founder of the Grand Frais brand.
But now such a division greatly complicates the organization of personnel elections.
Less rights for employees
However, the minimum threshold that authorizes the holding of elections for professional delegates and the Economic and Social Committee (CSE) is set at 11 employees. result: according to Progress, only some of the 300 stores in France have a CSE. This structure is therefore detrimental to employees, who do not benefit from the obligation to reclassify or from a works council, recalled the trade unionist on the air of BFM Lyonthis Wednesday.
As for the option of grouping the companies of the same store into a single economic and social unit, it is also difficult to implement. And this, “because the companies do not have the same activity”, explains Frédéric Leschiera.
To overcome this obstacle, the union plans to legally group the companies in a transversal way. Contacted by several Prosol employees, the organization is particularly interested in three stores in the Rhône: Pierre-Bénite, Bron and Rillieux-la-pape.
The court will rule on January 9. A decision that could pave the way for other appeals of this type within the brand’s stores.
