“One of the new rights of the Bioethics Law”: people born from PMA now have access to their origins

Once main, people born from assisted medical procreation can know their origins, an important advance claimed for a long time.

A fundamental step is crossed for children born to a donation during a medically assisted procreation: now they will have all access to their origins once adults.

“One of the new rights of the Bioethics Law” of 2021 “will enter into force for all children to be born,” said Minister of Health on Monday, March 31, Catherine Vautrin on Monday, March 31.

Once people, people born of a donation will have access to “identification data and non -identifiers” of the donor who has allowed their design: name or age, physical characteristics, professional and family situation, health, motivations, even a letter that would be directed to them.

Old donor brightness transfers

Since September 2022, each new gamete donor (sperm or oocyte) must consent to the future dissemination of this data.

The health authorities increased the results of the transition period on Monday, until March 30, destined to “optimize the use of gamete games constituted in the past under the anonymity regime.”

“On the stock of more than 100,000 brightness of former anonymous donors identified” at the end of 2022, “there are less than 30,000, which, for the majority, are useless”: either because the threshold of 10 births per donor has been reached, or because they do not comply with the current quality criteria, “said the biomedicine agency (ABM) in a press release.

The centers used these sequins of former donors as a priority. Those who had more, such as Rennes or Paris, transferred to those who had less.

“In 2024, 13 donation centers could benefit from the group of more than 10,000 sperm sequins,” specifies the ABM. “More than 200 pregnancies were underway at the end of December 2024 after the grouping of these glitters,” he said.

This brightness can no longer be used for new births, but they will not necessarily be destroyed, said Marine Jatelt, general director of ABM during a press conference.

A new action

It will be at each center to decide its destination, especially if used for medical research, destroyed or if you are looking to communicate with the donor to obtain your consent, he said.

Meanwhile, a new stock of 100,000 brightness was formed with the gametes of the new donors who agreed to raise the veil in their data.

This action corresponds to two years of AMP support with sperm donation. They are two thirds adapted to inseminations, often used by single women and couples of women who do not suffer from infertility, the agency said.

“This is what we saw abroad and this is confirmed in France: the survey of anonymity does not generate a drop in donations,” said Elodie Bougeard, president of PMUNONYME, an association that represents adults of a donation and defends access to the origin.

More than 10,600 women were waiting for an amplifier at the end of 2024

The thousand candidates for sperm donors crossed in 2024 (compared to 676 in 2023). The activity of medical assistance for procreation with sperm donation has multiplied by 8.5 compared to the period prior to the Bioethics Law that opened it to single and women couples.

More than 10,600 women were waiting for an amplifier with sperm donation in the late 2024: 45% of single women, 38% of women as a couple with a woman, 17% of women as a couple with a man.

With the end of the PMA with anonymous donors, “it is a fight of our association that leads today,” Mrs. Bougeard reacted.

“It is important for a person born of a gift of knowing their medical history. We cannot recognize ourselves in certain family members with whom we grew up and we are legitimate to know what comes from this donor,” he continues.

To find out the identity of his father, 701 donation adults contacted the Access Commission for people born of medical assistance to procreation to the data of third -party donors (Capadud) between 2022 already late January.

A long procedure that rarely leads: 73 have obtained identification or non -identifiers data, the biomedicine agency said Monday.
