Marine Le Pen activates a new legal lever. A few months after his conviction in the case of European parliamentary attendees of the National Demonstration to four years in prison, including two closed, as well as five years of inelegability, the President of the RN Group in the Assembly transmitted a request to the European Human Rights Court (CEDR) of Europe.
This application is made in the application of article 39, “in the presence of an imminent risk of irreparable damage to a right protected by the European Convention on Human Rights, when they are necessary in the interest of the parties or the operation without problems of the procedure” according to judicial regulations.
Another request was made on the basis of article 34 asking the court “to take into account the violation of the rights guaranteed by the European Convention for the Protection of Human Rights and for its additional protocols.”

“The absence of effective appeal before our national courts that make it possible to challenge the provisional execution of inelegability violates several guaranteed rights,” said Marine Le Pen’s press release.
“Marine Le Pen, therefore, asks the CEDR, without prejudice to the procedure in progress before the National Courts, to order the French authorities who now put a term to the provisional execution of their ineligibility pray who writes at the beginning of the press.
The provisional execution of the Inelegability Judgment for five years prevents Marine Le Pen from being presented to any vote. This includes the next 2027 presidential election, but also possible legislative elections in case of dissolution of the National Assembly by the President of the Republic. She has already been an ex officio for her mandate as Departmental Councilor for Pas-de-Calais.
The president of the RN Group of the National Assembly appealed the decision of the Criminal Court of Paris.
