La France insoumise launches a petition against the “ban” on bank overdrafts in 2026

A European directive aims to limit abuses and better protect consumers by further regulating bank overdrafts, which from September 2026 would be considered true consumer credit.

La France insoumise announced this Friday, October 31, the

“As of November 20, 2026, overdrafts will be prohibited. You will have to ask your banker for authorization for each overdraft,” denounces the vice president of the National Assembly, Clémence Guette, in her petition.

The European directive aimed at strictly regulating bank overdrafts was adopted by the European Parliament, a measure that was ratified by an order signed by Emmanuel Macron in September.

Limit excesses and protect consumers

This reform aims to limit abuses and better protect consumers by further regulating bank overdrafts, which would be considered real consumer credit from September 2026.

Each application must be studied, accompanied by a solvency evaluation and detailed information on the cost of credit.

“More than 22% of French people are overdrawn on the 16th of the month. Today, these people survive thanks to the authorized overdraft,” warns Clémence Guette, who states that the petition reached more than 15,000 signatures “in a few hours.”

The rebel deputy from Val-de-Marne believes that “if people are overdrawn, it is not because they mismanage their money, but because in Macron’s France prices skyrocket and salaries stagnate.”

On September 21, 2023, LFI European MP Manon Aubry, who had nevertheless voted in favor of this European directive, explained on her site that this reform proposal “goes in the direction of better consumer protection.”

A bill aimed at “returning the right to overdraft”

The movement, supported in this campaign by its leader Jean-Luc Mélenchon, also presented a bill aimed at “restoring the right to uncover and eliminating abusive burdens.” He calls for “the repeal of this measure” to be included on the agenda of the National Assembly, while Parliament is currently debating the budget.

Rebellious France also accuses the Socialist Party and the National Rally of having abstained during the vote in the Assembly on a law that transposes this European directive.
